[Petition of Roger de Morteyn and his wife Isabel for a fairer apportionment of responsibility for the debts of William of Louth, late bishop of Ely, between Isabel and Roger and Isabel's coheir, William Tuchet].

Morteyn. To the petition of Roger de Morteyn and Isabel his wife, one of the heirs of William of Louth, formerly bishop of Ely, deceased, requesting a remedy for the fact that, whereas they do not hold a quarter of the lands which the said bishop acquired in his life, because William Tuchet, the other heir of the same bishop, was enfeoffed jointly with the same bishop with the greater part of the land which the same bishop acquired etc., the same William Tuchet, [memb. 118, verso] recently appearing at the exchequer, gave the treasure and barons there to understand that the same Roger and Isabel in equal measure hold half the lands that belonged to the aforesaid deceased, through which information the same Roger and Isabel are burdened at the said exchequer with half of all the debts which the said deceased owed the king on the day on which he died, as if they held half the aforesaid lands: that all the lands which descended both to them and to the said William Touchet through the death of the said bishop, that is both those lands with which the said William Tuchet was jointly enfeoffed and the other lands, might be valued, and each party burdened with the aforesaid debts according to the share which he holds, and the said Roger and Isabel request that in the meantime they might enjoy a respite from the £128 4s. 5d. halfpenny which are demanded from them through a summons from the exchequer and through writs, until the aforesaid lands are valued and the aforesaid debts apportioned etc., this answer is given: the treasurer and barons of the exchequer are to be ordered by a writ of chancery to enquire into all the lands and tenements which master William of Louth, formerly bishop of Ely, held in fee on the day on which he died, into whomsoever's hands they have come, and to have them valued, and to have each of the tenants of the aforesaid lands burdened with the debts which they owe the king, according to the share which they hold of them etc. And in the meantime Roger and Isabel his wife, who hold part of the aforesaid lands, are to have a respite etc.

William de Louth died seised about 1298, when his heirs were William, afterwards Sir William, Touchet, his nephew, and Isabel wife of Roger de Morteyn, [Chan. Inq. p.m. Edw.
