In 1201, Gilbert de Notton released to Akaris de Austwick all his title of three plough lands in Cantsfield. A year afterwards, Akarias came to an agreement with William de Tunstall and his son Thomas, respecting boundaries and common rights. (Thomas de Tunstall and his brother William occur as witnesses in the Fountains Chartul. [Fol. 157b].) Akarias held the namor of Cantsfield at the beginning of 1208, when a dispute is recorded with Hugh de Morewick. The dispute was settled at the end of the same year by Richard de Heggefild, Godith his wife, Thomas de Tunstall, Maud his wife, Ingrith, John and Akariason one side and Hugh de Morewich on the other. It is probable that Godith, Maud and Ingrith were the daughters and heirs of Akarias de Austwick, John and Arkarias being near of kin and tenants also.

"At Lancaster, on Tuesday next after the feast of all Saints, 4 John (5 Nov 1202).

"Between Akarias de (Oust)wick, plaintiff, and William de Tunstall, Thomas his son, tenants, by the said Thomas put in the said William's place, etc., of 100 acres of land with the appurtenances, beyond the stream which runs between Alnov and Tunstall, and the several meadows of Canceveld and Tunstall, as far as the stream of Lone.

"Akarias quit-claimed his right to the land to William and Thomas and their heirs. And for this quitclaim they granted to him 4 hills to with, Scaleberge, Herdhappelire, Withenkenberg, and Sorithsteinberg, from the brook between Scaleberg and Lethoneberg downwards as that brook runs into Kant, and so upwards by the brook which comes from Watriveling and runs down towards Crosseberg, to lie uncultivated for common pasture of all their beasts in Tunstall and Canceveld for ever."

Thomas married Matilda de Austwick, daughter of Akaris de Austwick and Unknown.⁷⁷⁵ (Matilda de Austwick died after 1209 in Thurland, Lancashire, England ⁷⁷⁵.)
